PROGRESSING BALLET TECHNIQUE (PBT) WORKSHOP PARTICIPATION WAIVER

Liability Release and Acknowledgment of Risk:

I agree to release and forever discharge Progressing Ballet Technique (PBT), Progressing Contemporary Technique (PCT), their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the activities conducted by, on the premises of, or for the benefit of, Progressing Ballet Technique (PBT) provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful, or wanton misconduct.I understand that this participation involves certain risks, including injury. I am voluntarily participating in these activities with knowledge of the danger involved, and agree to assume any and all risks of bodily injury or property damage, whether those risks are known or unknown.

Health and Safety Commitment:

In light of public health concerns, I confirm that:

I have not been in contact with a confirmed case of COVID-19.
I am not displaying any flu-like symptoms.
I do not have any pre-existing health conditions that would place me at a high risk of COVID-19.
I have not visited or been in contact with anyone from any hotspot locations as defined by health authorities.

I agree to comply with all health directives from the World Health Organization and local health authorities, including social distancing measures, hygiene practices, and public gathering restrictions. I understand that if these guidelines are not adhered to, PBT directors reserve the right to request my departure from the workshop.

Governing Law:

This agreement and any dispute arising out of it will be governed by, construed, and enforced in accordance with the laws of Australia, regardless of the conflict of laws principles.

Age of Participants:

I declare that I am 17 years of age or older, or that I am the legal guardian of the registered participant who is under the age of 17, and agree to this waiver on their behalf.

Media Release:

I consent to the filming, photographing, and recording of my participation in the workshop. I grant PBT the irrevocable right to use such materials for promotional, educational, and/or commercial purposes without further compensation.

Acknowledgment of Online/Virtual Zoom Workshops:

I understand that the registration for the online/virtual workshop via Zoom or any other digital platform is solely for my use and must not be shared with any other individual. This includes prohibiting more than one person from viewing the workshop through my registered access. I agree not to share any workshop materials, notes, meeting IDs, or passwords with anyone else. Any violation of these terms may result in my being denied certification of the workshop by PBT instructors and potentially facing further restrictions on future participation.

Non-Compete Agreement:

I hereby agree that I shall not organise, host, or advertise any event titled as a 'workshop' that uses the Progressing Ballet Technique or PBT® brand for teachers. Nor shall I organise, host, or advertise any classes for students using the 'workshop' title in association with the Progressing Ballet Technique or PBT® brand. However, I may hold or advertise events such as Progressing Ballet Technique or PBT® Masterclasses or similar classes without using the word 'workshop' in association with these brand names.

Accessibility and Inclusivity:

PBT strives to conduct workshops in accessible venues. If I require special accommodation, I will contact PBT prior to the workshop to verify the accessibility of the venue.

Dispute Resolution:

Any disputes under this agreement shall be resolved through final and binding arbitration conducted in Australia according to the rules of the Australian Arbitration Association.

Severability:

If any term or provision of this Waiver is found to be illegal or unenforceable, this will not affect the legality or enforceability of any other term or provision.

Acknowledgment:

I acknowledge that I have read and understood this waiver, and agree to be bound by its terms.
