Terms of Service for Progressing Ballet Technique

1. Acceptance of these Terms

By creating an account, subscribing to a membership, registering for a workshop, or otherwise using PBT's services, you agree to these Terms and our Privacy Policy.

2. Our services

PBT provides an online membership platform including teacher certification, a training video library, in-person workshops, and merchandise sold through our online store, which is operated through Shopify.

3. Accounts

You must provide accurate information when creating an account and are responsible for keeping your login details secure. You must be an adult aged 18 or over, or have the involvement of a parent or guardian where we allow that, to hold an account or make a purchase.

4. Subscriptions and refunds

Online subscriptions: Monthly subscriptions qualify for a refund if cancelled within the first half of the billing period. Yearly subscriptions qualify for a refund if cancelled within the first month. If you cancel outside these periods, you will retain access until the end of the current billing cycle without a refund.

If you are a consumer in the European Union or United Kingdom, you additionally have a statutory right to cancel your first subscription payment within 14 days of purchase for a full refund under applicable distance-selling consumer protection law. This right may not apply once you have expressly asked us to start providing the service immediately and acknowledged that you are giving up the 14-day right. It does not apply to renewal payments after your first billing cycle. Nothing in this paragraph limits any cancellation right that cannot lawfully be excluded.

5. Workshops

For any concern, cancellation, refund request, or registration transfer, contact customerservice@pbt.dance.

  • 30 or more days before the workshop: a full refund or credit is available.
  • Between 15 and 30 days before the workshop: a credit is available for a workshop conducted by the same tutor or in the same country as the originally booked workshop.
  • Less than 15 days before the workshop: no refund or credit is available unless we can fill your spot from the waitlist. You may transfer your registration to another person, or we may offer a coupon for one year of online training.
  • Sold-out workshops: if we can fill your spot from the waitlist, we will provide a full refund or credit.
  • Registration transfers: you may transfer your registration to someone else by giving at least 72 hours' notice before the workshop.

6. Intellectual property

All content on PBT's platforms, including videos, written materials, training materials, logos, trademarks, and branding, is the exclusive property of PBT. Unauthorised use, copying, or redistribution is strictly prohibited.

7. AI and automated tools

Some parts of our service use automated tools, including AI-assisted content translation and rule-based scoring in our marketing systems. Our Privacy Policy forms part of these Terms and explains these tools in full.

8. Your consumer rights

Nothing in these Terms excludes, restricts, or limits any right, guarantee, or remedy you have under law that cannot lawfully be excluded. This includes the non-excludable consumer guarantees under the Australian Consumer Law and rights under applicable European Union and United Kingdom consumer protection law. Where our liability for failing to meet a non-excludable guarantee can lawfully be limited, our liability is limited, at our option, to re-supplying the service or refunding what you paid for it.

9. Liability

PBT is not liable for injury or damage arising from participation in workshops or use of our training content, except to the extent caused by our negligence or where liability cannot lawfully be excluded under Section 8. Participants assume the ordinary risks of physical dance training. This section does not override Section 8.

10. Resolving a dispute

If you have a concern, please contact us first at customerservice@pbt.dance so we can try to resolve it directly.

If we cannot resolve the issue informally, these Terms are governed by the law of New South Wales, Australia. Except where your local consumer protection law gives you the right to bring a claim in your home courts, which we do not take away, disputes will be handled in the courts of New South Wales.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new last-updated date and, where a change is material, take reasonable steps to let you know before it takes effect.
